Firebowl – Terms and Conditions

By accessing, registering for, or using Firebowl SmartPOS, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree with these Terms, you must discontinue use of the Services immediately.

These Terms define your rights, obligations, and responsibilities when using the Firebowl SmartPOS platform and establish the legal framework governing your relationship with Firebowl.

1.1 Firebowl SmartPOS
Firebowl SmartPOS is a cloud-based point-of-sale and business management platform designed for restaurants, cafés, food vendors, and hospitality businesses. The platform provides tools for order processing, billing, inventory management, reporting, employee management, and business analytics.

1.2 Services
“Services” refers to all software, websites, dashboards, applications, tools, modules, features, and technologies provided through Firebowl SmartPOS, including updates, upgrades, and future enhancements.

1.3 User
A “User” refers to any individual, business, or organization that accesses, registers, or uses the Firebowl SmartPOS platform.

1.4 Merchant or Business Account
A “Merchant” or “Business Account” refers to a registered restaurant, food business, or organization that uses Firebowl SmartPOS for managing sales, operations, and business activities.

1.5 Authorized Staff
Authorized Staff refers to employees, managers, or representatives granted access to the Firebowl SmartPOS system under a registered business account.

1.6 Platform
The “Platform” refers to the Firebowl SmartPOS website, dashboard, and software infrastructure through which users interact with the Services.

2. Acceptance of Terms

2.1 Agreement to Terms
By creating an account or using Firebowl SmartPOS, you agree to comply with these Terms and all applicable policies published on our platform.

2.2 Updates to Terms
Firebowl reserves the right to update, modify, or revise these Terms at any time. Updated versions will be posted on our website with a revised effective date. Continued use of the Services after updates constitutes acceptance of the modified Terms.

2.3 Eligibility

To use Firebowl SmartPOS, you must:

  • Have legal authority to operate a business or represent an organization
  • Comply with all applicable local and international laws

Firebowl reserves the right to suspend or terminate accounts that fail to meet these requirements.

Firebowl continuously improves the platform and may modify or introduce new features at any time.

4. Account Registration

4.1 Account Creation

You agree to provide accurate and up-to-date information during registration and to update such information if it changes.

4.4 Staff Accounts
Businesses may create multiple staff accounts with varying permission levels. The primary account holder is responsible for all activity conducted through staff accounts.

5. Subscription, Pricing, and Payment

5.1 Subscription Plans
Firebowl SmartPOS may offer different subscription tiers depending on features, number of users, locations, or devices supported.

5.2 Payment Requirements
Access to certain features may require payment of subscription fees. Payments must be made through approved payment methods provided by the platform.

5.3 Billing Cycles
Subscriptions may be billed monthly, annually, or according to other billing cycles defined by the platform.

5.4 Price Changes
Firebowl reserves the right to modify subscription pricing at any time. Users will be notified of material pricing changes before they take effect.

5.5 Failure to Pay
If subscription payments are not completed, Firebowl may suspend or restrict access to the Services until outstanding payments are resolved.

6. Acceptable Use and User Responsibilities

Users agree to use Firebowl SmartPOS responsibly and only for lawful purposes.

Users must not:

  • Engage in illegal or fraudulent activities using the platform
  • Attempt to hack, reverse engineer, or exploit the system
  • Upload malicious software or harmful content
  • Use the platform to store or distribute illegal materials
  • Attempt to bypass subscription limits or system security controls

Firebowl reserves the right to suspend accounts involved in suspicious or harmful activities.

7. Data Responsibility

Firebowl SmartPOS processes and stores business-related operational data. This may include:

  • sales records
  • order details
  • customer data
  • inventory records
  • employee accounts

Users remain responsible for the accuracy and legality of data entered into the system.

Businesses must ensure they comply with applicable privacy laws when storing customer information through Firebowl SmartPOS.

8. Intellectual Property Rights

8.1 Ownership
All intellectual property rights related to Firebowl SmartPOS including software, designs, code, trademarks, logos, and content are owned by Firebowl or its licensors.

8.2 License to Use
Users are granted a limited, non-exclusive, non-transferable license to use the platform solely for legitimate business purposes.

8.3 Restrictions

  • Copy or redistribute the software
  • Resell or sublicense the platform without authorization
  • Modify or replicate the system architecture
  • Use Firebowl SmartPOS technology to build competing platforms

9. Service Availability

Firebowl aims to provide reliable and continuous access to the SmartPOS platform. However, service availability may occasionally be affected by maintenance, software updates, technical issues, network disruptions, or events beyond reasonable control.

While reasonable efforts are made to minimize downtime, Firebowl does not guarantee uninterrupted or error-free service operation at all times.

Scheduled maintenance may be conducted periodically in order to improve platform functionality, security, and performance. In such cases, users may be notified in advance whenever possible.

10. Limitation of Liability

To the fullest extent permitted by law, Firebowl shall not be liable for any indirect, incidental, consequential, or special damages arising from the use or inability to use the SmartPOS platform. This includes but is not limited to loss of profits, loss of business data, operational disruptions, or reputational damages.

Users acknowledge that the platform is provided as a software tool to assist with business management and that ultimate responsibility for financial decisions, business operations, and compliance remains with the user.

In no event shall Firebowl’s total liability exceed the amount paid by the user for the subscription during the most recent billing period.

11. Termination

Firebowl reserves the right to suspend or terminate user access to the platform if these Terms and Conditions are violated or if activities are detected that threaten the security, integrity, or lawful use of the platform.

Users may terminate their subscription at any time in accordance with the cancellation policies outlined in their subscription plan. Termination will result in the loss of access to the platform at the end of the current billing cycle unless otherwise stated.

Firebowl may also discontinue or modify services at its discretion with reasonable notice to users whenever possible.

12. Changes to Terms

Firebowl reserves the right to update or modify these Terms and Conditions at any time. Updates may be necessary due to changes in legal requirements, service offerings, technology improvements, or operational policies.

When changes are made, the revised version will be published on the website with an updated effective date. Continued use of the platform after such updates constitutes acceptance of the revised terms.

13. Governing Law
